Atlas Marine, LLC (“Atlas Marine,” “we” or “us”) has created this privacy policy in order explain our privacy practices. The following explains how we collect, use, share and protect your information, and how you can access your information and decide how it is used.

The Privacy Policy covers our activities online, including any our websites, such as www.atlasmarinetransportation.com (the “Site”).  It also covers our offline activities, such as collection of information through telephone or in person.  Our online and offline activities are referred to as the “Services.”

By using the Services, you hereby warrant and represent that you have read, understand and agree to all terms and conditions herein, including our Terms of Use, available here, which is incorporated herein by reference.  You further warrant and represent that you are giving Cargomatic permission to use and store such information consistent with this policy and our Terms of Use.

Information Received by Atlas Marine

Personal Information.

Atlas Marine collects personal information if you voluntarily choose to share such information. You may browse the Site without disclosing any personal information. However, to take advantage of particular opportunities provided through the Service, we may require that you furnish personal information for: 

(i) registration including your name, professional title, company name, phone number (including to use to call or text you in order to provide the Service) and email address; 

(ii) feedback or correspondence, such as information you provide when you contact us with questions, feedback, or otherwise correspondence with us online; 

(iii) demographic information such as your city, state, country of residence, postal code, and age; 

(iv) financial information, such as your billing name, address, and credit card number, ACH or other payment information;

(v) government-issued identified numbers, such as a national identification number (e.g., Social Security Number, tax identification number), state or local identification number (e.g., driver’s license of state ID number), and an image of the relevant identification card; 

(vi) precise geolocation information, such as when you authorize our mobile application to access your location; 

(vii) transaction information such as information about payments to and from you and other details of the Services you have purchased from us; 

(viii) usage information, such as information about how you use the Services and interact with us, including information associated with any content you submit to us, and information you provide when you use any interactive features of the Services;

(x) marketing information, such as information such your preferences for receiving communications about our activities, events, and publications, and details about how you engage with our communications;

(xi) information provided by job applicants, such as professional credentials and skills, educational and work history, and other information of the type that may be included on a resume or curriculum vitae; and

(xii) other information that we may collect which is not specifically listed here, but which we will use in accordance with this Privacy Policy or as otherwise disclosed at the time of collection. 

Information we obtain from social media platforms. We may maintain pages for Atlas Marine on social media platforms, such as Facebook, LinkedIn, Twitter, YouTube, Instagram, and other third party platforms. When you visit or interact with our pages on those platforms, the platform provider’s privacy policy will apply to your interactions and their collection, use and processing of your personal information. You or the platforms may provide us with information through the platform, and we will treat such information in accordance with this Privacy Policy.

Information we obtain from other third parties.  We may receive personal information about you from third-party sources. For example, a business partner may share your contact information with us if you have expressed interest in learning specifically about our products or services, or the types of products or services we offer. We may obtain your personal information from other third parties, such as marketing partners, publicly-available sources and data providers.

Usage Information, IP Address and other information. Atlas Marine, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and activity occurring on or through the Services, using various technologies. The information that may be collected automatically includes your computer or mobile device operating system type and version number, manufacturer and model, device identifier (such as the Google Advertising ID or Apple ID for Advertising), browser type, screen resolution, the website you visited before browsing to our website, general location information such as city, state or geographic area; and information about your use of and actions on the Services, such as pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, length of access, and Internet Protocol Address (“IP address”).  The IP Address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider. This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time of your visit(s) and the pages you visited. We, our service providers and/or our business partners may use IP Addresses to monitor locations from which Users navigate the Site and for fraud prevention. Our service providers and business partners also may collect this type of information over time and across third-party websites and mobile applications. 

We, our service providers, and our business partners may collect and store certain data about the use of the Services on an aggregate and/or anonymous basis. This information may be non-identifying or may be associated with you. Whenever we associate usage information with your personal information, we will treat it as personal information.

In addition to collecting general location information, tracking information, such as geographic areas, is collected as you navigate through our Services and/or use the mobile application. We collect this information for various purposes, including to provide you with support, to notify carriers as soon as shipments are available nearby, to keep shippers or consignees informed of arrival times, to help dispatchers or shippers know where drivers are headed, to enhance our Services, and for our internal business purposes.

Cookies and Other Technologies.  Like many websites, we may use “cookies” to collect information. A cookie is a data file placed on a device when it is used to access the Services. A Flash cookie is a data file placed on a device via the Adobe Flash plug-in that may be built-in to or downloaded by you to your Device. Cookies and Flash Cookies may be used for many purposes, including, but not limited to, remembering you and your preferences and tracking your visits to our web pages. 

Cookies work by assigning a number to the user that has no meaning outside of the assigning web site. We may also use Flash Cookies on our website to collect and store information about your use of our website. Unlike cookies, Flash Cookies cannot be removed or rejected via your browser settings. If you do not want Flash Cookies stored on your computer or mobile device, you can adjust the settings of your Flash player to block Flash Cookies storage using the tools contained in the Website Storage Settings Panel. You can also control Flash Cookies by going to the Global Storage Settings Panel and following the instructions. Please note that setting the Flash Player to restrict or limit acceptance of Flash Cookies may reduce or impede the functionality of some Flash applications, including, potentially, Flash applications used in connection with our website.

We may utilize persistent cookies that only Atlas Marine can read and use to save your login information in the event we require users to register to access or use certain portions of the Site or to use other Services in the future, to hold session information, and to track user preferences. We may utilize session ID cookies to enable certain features of the Service, to better understand how you interact with the Site and to monitor aggregate usage by our users and web traffic routing on the Services. Session cookies are deleted from your computer when you log off from the Site and Services and then close your browser, while persistent cookies remain. If you do not want information to be collected through the use of cookies, your browser allows you to deny or accept the use of cookies. Cookies can be disabled by setting a preference within your web browser or on your device. If you disable cookies or Flash cookies on your device, you will not be able to use all portions or all functionalities of the Services.

We and our service providers may also use “pixel tags,” “web beacons,” “clear GIFs,” or similar means in connection with the Services and HTML-formatted email. Web beacons or similar technologies help us better manage content on our Services by informing us what content is effective, count users of the Services, monitor how users navigate the Services, or count how many e-mails were actually opened. 

 

How We Use Your Information

Our primary goal in collecting information is to provide you with an enhanced experience when using the Services.

Atlas Marine uses personal information for the following general purposes:

  • to provide, operate, maintain, and enhance our products and the Service;
  • to provide you with information, administrative notices and communications relevant to your use our products and services;
  • to process your registration with the Services, including verifying your information is active and valid;

  • to contact you for administrative purposes such as customer service, to address intellectual property infringement, defamation issues or privacy violations related to user content, or to send communications, updates, and promotions related to products and services;
  • in the case of cookies and automatically-collected information, to personalize or customize our Services (for example, with auto-population of sign-in fields), provide customized content and information, track your participation in any activities on the Service, and in the case of carriers and shippers, to track the location of shipments transported through the Service;
  • for billing, identification and authentication, and fraud prevention;
  • for internal business purposes;
  • to analyze Site usage, improve our products and the Service, and develop new products, services, features and functionality;
  • for troubleshooting problems, market research, and detecting and protecting against error, fraud or other criminal activity;
  • to conduct market research about the Service, and/or usage or Users of the service, including in order to market the Service;
  • to send you marketing and promotional communications (as permitted by law), however you may have an opportunity to opt out (as described in the Opt Out section); 
  • to help diagnose problems with our computer server and to administer our web site(s);
  • to enforce our Terms of Use; and
  • as otherwise set forth in the Policy.

When We Disclose Your Information

We will not disclose your information to third parties without your consent, except as disclosed in this policy. We may disclose information to third parties in the following circumstances:

  • Any information you include in a publicly-accessible area of the Service, such as a public profile page, will be available to anyone who has access to that content, including other users.
  • We may provide our customers with access to user information, including personal information, only as necessary to carry out or receive the services being provided. These parties are bound by privacy restrictions at least as restrictive as those set forth in this policy.
  • Third party service providers work on web site or application development, hosting, maintenance, and other services for us. These third parties may have access to and/or process your information, including personal information, in connection with providing these services. Such third party providers agree to maintain the confidentiality of such information.
  • We may share non-personally identifiable information, such as aggregated user statistics and log data, with third parties for business purposes.
  • We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. Thus, we may access, use, preserve, transfer and disclose your information (including personal information) if required to do so by law or in the good-faith belief that disclosure is necessary to comply with applicable laws in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies, or to protect the safety, rights and property of Atlas Marine, our Services or any third party. Such disclosures may be carried out without notice to you.
  • User information, including personal information, may be disclosed and/or transferred to an acquirer, or successor or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, as well as in the event of an insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.
  • We also may disclose your information as may be described to you at the time the information is collected, or in any other manner to which you consent.
  • We may share your personal information for the compliance, fraud prevention and safety purposes described above.  

We do not sell, share, rent or trade the information we have collected about you, including personal information. We may share your personal information with third parties for those third parties’ direct marketing purposes.

Although we ensure that our third party agents receiving your information are bound by privacy restrictions at least as restrictive as those set forth in this policy, Atlas Marine is not responsible for any issues that may arise regarding the privacy policies of any such third parties. By using this Site, you do hereby agree to Atlas Marine harmless from any claims and/or damages that may arise from the actions of any third parties.

Atlas Marine reserves the right to disclose personal information from both private and public areas of this website at our discretion, if required by law, in order to comply with a judicial proceeding, court order or legal process or if we are given reason to believe, in our sole discretion, that someone is causing injury to or interference with the rights of Users, the general public, or Atlas Marine.

Atlas Marine reserves the right to transfer, sell and/or distribute all information collected through the Services to an affiliate, subsidiary, or third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or part of our business, assets or stock. We will use our best efforts to ensure that the new entity follows a substantially similar privacy policy with respect to your personal information, as and to the extent required by applicable law.

 

Do Not Track

Children

The Services are not directed to, and we do not knowingly collect personal information from, anyone under the age of 18. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us. We will delete such information from our files as soon as reasonably practicable.  We encourage parents with concerns to contact us. 

 

Opt-Out

You may decline to share certain personal information with us, in which case we may not be able to provide to you some of the features and functionality of the Services.

You may opt-out of receiving email campaigns from us by unsubscribing from such emails. You may also remove your information from our database by contacting us at legal@atlasmarinetransportation.com. If you receive unsolicited email from an Atlas Marine domain, please contact us at unsubscribe at the bottom of the email, or ask to unsubscribe by emailing support@atlasmarinetransportation.com

If you wish to update or delete any personal information we have, you may contact us at support@atlasmarinetransportation.com.

Note that while changes you make will be updated in user databases within a reasonable period of time, to preserve the integrity of our databases, we may retain information submitted by users for an indefinite length of time. If required by law, we will delete personal information by erasing it from our database.

 

Other sites, mobile applications and services

The Services may contain links to other websites, mobile applications, and other online services operated by third parties.  These links are not an endorsement of, or representation that we are affiliated with, any third party.  In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third party websites, mobile applications or online services, and we are not responsible for their actions.  Other websites and services follow different rules regarding the collection, use and sharing of your personal information.  We encourage you to read the privacy policies of the other websites and mobile applications and online services you use.

 

Atlas Marine’s Security of Collected Information

We utilize many physical and technical safeguards to create and improve the integrity and security of your personally identifiable information. Further, only certain authorized Atlas Marine staff can access personal information, and then only if it is relevant to their job duties. Atlas Marine also has staff dedicated to ensuring the security of its platform. However, unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As such, we cannot guarantee the security of any information you transmit to us, and you do so at your own risk.

While Atlas Marine will use commercially reasonable efforts to ensure the security of all credit card and all other personal information, we expressly disclaim any liability for any unauthorized access to or use of our secure servers and/or any and all personal and/or financial information stored therein, and you agree to hold Atlas Marine harmless for any damages that may result therefrom. Atlas Marine expressly disclaims any liability that may arise should any other individuals obtain the information you submit to this website.

 

International Use

The Services are hosted in the United States and is intended for visitors located in the U.S. If you use the Services from other regions of the world with different governing laws, please note that you are transferring your personal information from those regions to the U.S. for storage and processing. By providing any information, including personal information, on or to the Service, you consent to such transfer, storage, and processing.

This California Applicant Privacy Notice (“Applicant Notice”) describes our information practices relating to applicants and candidates for employment with Atlas Marine, LLC, or our affiliates or subsidiaries (“Atlas Marine,” “we,” “our,” “us,” or the “Company”) who are California residents (each an “Applicant” or “you”). 1. Scope and Relation to Other Policies

This Applicant Notice applies to any information we collect about our Applicants that identifies, relates to, describes, is reasonably capable of being associated, or could reasonably be linked, directly or indirectly, with an individual (“Personal Information”). Our information practices may vary depending upon certain circumstances, such as the location or role for which you are applying.

This Applicant Notice does not address or apply to our information practices that are not subject to the CCPA, such as:

  • Publicly Available Information. Information that is lawfully made available from government records, information we have a reasonable basis to believe is lawfully made available to the general public by you or by widely distributed media, or by a person to whom you have disclosed the information and not restricted it to a specific audience.
  • Deidentified Information. Information that is deidentified in accordance with applicable laws.
  • Aggregated Information. Information that relates to a group from which individual identities have been removed.
  • Protected Health Information. Information governed by the Health Insurance Portability and Accountability Act or California Confidentiality of Medical Information Act.
  • Activities Covered by the Fair Credit Reporting Act. This includes information we receive from consumer reporting agencies that are subject to the Fair Credit Reporting Act, e.g., information contained in background check reports we obtain as part of our vetting process.

This Notice also does not apply to the Personal Information we collect from our customers, contractors, employees, or our Applicants in the context of their personal use of our products and services, which are subject to different notices. We may provide Applicants additional notices about our information practices that are covered by other laws (e.g., if we conduct a background check).

2. What Personal Information Do We Collect?

The following identifies the categories of Personal Information we collect about Applicants (and have collected in the prior 12 months), as enumerated by the CCPA.

  • Identifiers. Such as real name, alias, job title, address, unique personal identifier, online identifier, email address, date of birth, social security number, driver’s license number, and other government identifiers.
  • Characteristics of Protected Classifications. Such as age (40 years or older), race, ancestry, national origin, citizenship, physical or mental disability, sex, veteran or military status, and other characteristics of protected classifications under California or federal law.
  • Internet or Other Electric Network Activity Information. Such as information about applicants’ interaction with our portals, website, applications, or advertisements, including, but not limited to, browsing history, clickstream data, and search history.
  • Audio, Electric, Visual, or Similar Information. Such as information collected via call recordings, recorded meetings, videos, photographs, and video footage to secure our offices and premises.
  • Employment-Related Information. Such as previous positions held, skills and experience, job duties, certifications, and licenses.
  • Education Information. Such as education records, including grades, transcripts, student disciplinary records, or any other related information you chose to provide.
  • Sensitive Personal Information. Such as your social security number, driver’s license number, race or ethnic origin, medical condition, and physical or mental disability.
  • Inferences and Preferences. Such as inferences and preferences reflecting an Applicant’s preferences, characteristics, attitudes, behaviors, and abilities.

3. Sources of Personal Information

We generally collect the categories of Personal Information identified above from the following categories of sources:

  • Directly from you;
  • From recruiters and recruiting platforms;
  • From publicly available information and sources;
  • From former employers (with your prior permission);
  • From our service providers, representatives, and agents; and
  • From any references you provide.

4. Why Do We Collect Personal Information?

We generally collect Personal Information as reasonably necessary for the following business or commercial purposes, as permitted by applicable laws:

  • Recruiting and Hiring. We use Personal Information from your application and collected through the interview process to evaluate your qualifications and eligibility for employment. This includes identifying Applicants, scheduling interviews, conducting background checks, evaluating qualifications, extending offers, communicating with Applicants, maintaining Applicant information for future consideration, and supporting our equal opportunity employment practices.
  • Defending and Protecting Rights. We use Personal Information to protect and defend our rights and interests and those of third parties, including to manage and respond to Applicant and other legal disputes, to respond to legal claims or disputes, and to otherwise establish, defend or protect our rights or interests, including without limitation, Atlas Marine’s trade secrets and other intellectual property, and protecting the rights, property, and reputation of Atlas Marine and its workforce, or the rights, interests, health or safety of others, including in the context of anticipated or actual litigation with third parties.
  • Compliance with Legal Obligations. We use Personal Information to comply with applicable legal obligations (such as determining hiring eligibility or responding to subpoenas and court orders) as well as assessments, reviews and reporting relating to such legal obligations, including under employment and labor laws and regulations, Social Security and tax laws, environmental regulations, workplace safety laws and regulations, and other applicable laws, regulations, opinions, and guidance.

We may use Personal Information for other business or commercial purposes depending on the context, but we will provide you with additional notice (and, if necessary, obtain your consent) prior to doing so.

5. Disclosure of Personal Information

A. Purposes for Disclosing Personal Information

We may disclose the categories of Personal Information identified in Section 2 for the following business purposes.

  • To Evaluate Your Application/Candidacy. We may disclose Personal Information when it is necessary to provide services you request and where it is necessary to identify Applicants, schedule interviews, and otherwise evaluate your qualifications and eligibility for employment.
  • To Enforce Rights. We may disclose Personal Information if required to do so by law, to protect our rights, property, or the safety of others, or where we have a legitimate interest in doing so.

B. Categories of Recipients

We may disclose Personal Information to the following categories of recipients:

  • Affiliates and Business Partners. We may disclose Personal Information to our affiliates and business partners where necessary to evaluate your candidacy for employment or for business operations purposes.
  • Service Providers. We may disclose Personal Information to our service providers who perform services on our behalf, such as recruiters or recruitment platform providers. Our service providers are required to take appropriate security measures to protect your Personal Information in line with our policies and are not permitted to use Personal Information for their own purposes.
  • Government Entities and Agencies. To comply with our legal obligations and where otherwise required by law, we may disclose the following categories of Personal Information to applicable regulatory and government entities: identifiers, characteristics of protected classifications, and employment-related information.
  • Data Analytics Providers. To assess the effectiveness of our careers page, we may disclose the following categories of Personal Information to data analytics providers: identifiers and internet and network activity information.
  • Other Parties With Your Consent. Personal Information may also be disclosed to a third party but only at your request and with your consent.

6. How Long Do We Retain Personal Information?

Rather than delete your Personal Information, we may also deidentify it in accordance with the CCPA, by removing identifying details. Where we have committed to maintaining and using Personal Information in a deidentified form, we agree not to reidentify deidentified data except as permitted by applicable law.

7. Security

Atlas Marine takes reasonable and appropriate administrative, technical, and physical measures designed to protect the Personal Information we collect from accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access.

Please be aware that despite our efforts, no data security measures can guarantee security. You should take steps to protect against unauthorized access to your passwords and login details.

8. Your California Privacy Rights

A. Applicant Privacy Rights

If you are a California resident, you may have additional rights regarding your Personal Information under the CCPA. These rights are subject to certain exemptions and exclusions, and include:

Right to Know/Access. You have the right to request:

  • The categories of Personal Information we collected about you;
  • The sources from which we have collected that Personal Information;
  • Our business or commercial purpose for collecting, selling, or sharing that Personal Information;
  • The categories of third parties to whom we have disclosed that Personal Information; and
  • A copy of the specific pieces of Personal Information we have collected.

Right to Correct. You have the right to request that we correct inaccuracies in your Personal Information.

Right to Delete. You have the right to request deletion of Personal Information that we have collected from you. Note, however, that we are unable to delete Personal Information if we are required to maintain it to comply with applicable laws.

Right to Opt-Out. Under the CCPA, California residents may have the right to opt-out of the “sale” or “sharing” of Personal Information. California CCPA defines a “sale” as disclosing or making available to a third-party Personal Information in exchange for monetary or other valuable consideration, and “sharing” broadly includes disclosing or making available Personal Information to a third party for purposes of cross-context behavioral advertising. Other than as may be disclosed in our main privacy policy, we do not sell or share applicant Personal Information. We do not sell or share any Personal Information about individuals who we know are under 16 years old.

Right to Limit Use and Disclosure. Subject to certain conditions and exceptions, you may have the right to limit the use and disclosure of “Sensitive Personal Information,” as defined under the CPRA. However, we do not engage in activities triggering this right.

Right to Non-Discrimination. We will not discriminate against you for exercising any of the rights described in this section.

B. Exercising Your California Privacy Rights

Please indicate you are exercising your “CCPA rights.” Atlas Marine will need to confirm your identity before fulfilling the request, so please provide us with your full name, the email address you used to communicate with us, your address, and any applicant number you were assigned. In some cases, we may request additional information in order to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we will deny the request and will explain the basis for the denial.

You may designate someone as an authorized agent to submit requests and act on your behalf. To do so, you must provide us with written permission to allow the authorized agent to act on your behalf. We may also ask you directly to verify that you have authorized your authorized agent to act on your behalf.

This Applicant Notice is reviewed and updated periodically consistent with applicable law and to ensure it accurately describes our information practices and procedures. When we update this Applicant Notice, we will also revise the “Last Updated” date at the top of this document.
